Article 1 - Definitions
ACCESS'MOBILE SASU with variable capital of 1000.00€, whose acronym is A'M and whose commercial name is ACCESS'MOBILE, whose registered office is located at 93 rue lallouette, 97300 CAYENNE, and registered with the Registre du Commerce under number 90973041800011APE: 4652Z.
The term "Site" refers to ACCESS'MOBILE's website: access-mobile.fr.
Article 2 - Scope
The present General Terms apply to products and services commercialized by ACCESS'MOBILE on behalf of the customer. Any order placed by the customer implies acceptance without reservation of the entirety of these general conditions of sale. These terms and conditions shall prevail over any terms and conditions of purchase of the customer that have not been approved in writing by ACCESS'MOBILE
Article 3 - Validity of the offer
The offers proposed by ACCESS'MOBILE are provided subject to typographical error and are valid until their expiry date or cancellation. ACCESS'MOBILE reserves the right to modify these offers at any time and without notice.
Article 4 - ordering
Orders may be placed in store, by e-mail or by telephone. In the latter case, the order must be confirmed in writing (letter, e-mail or fax). An order only becomes definitive once it has been accepted by ACCESS'MOBILE . If no objection is received from the customer within 24 hours of receipt of the acceptance of the order, the present terms and conditions of sale shall be deemed to have been accepted in their entirety by the customer.
Article 5 - prices and availability
Prices are available in the store and on the website. They are quoted in euros and include all taxes. They do not include delivery charges. These prices are given as an indication, subject to typographical error, and may be modified without notice and at any time by ACCESS'MOBILE . The prices invoiced to the customer by ACCESS'MOBILE are those in effect at the time the order is accepted by both parties. Orders for special services and products not included in ACCESS'MOBILE's price list will be invoiced at the price agreed on the commercial proposal.
5.2 Availability
The availability of products shown on the site indicates the state of stock of the product in question at the precise moment when the web page was generated. This information is given for information only and is subject to stock errors, and is updated in real time from the database.
Article 6 - delivery
Delivery times are given for information only. ACCESS'MOBILE shall not be held responsible for failure to meet delivery deadlines, nor shall ACCESS'MOBILE be held responsible for cancellation of the order. It is the customer's responsibility to verify the conformity of the products delivered in kind and quantity. In the event of non-conformity, the customer must, under penalty of forfeiture, formulate his complaints within eight (8) days after receipt.
Article 8 - warranty
8.1 duration
Unless otherwise stated, ACCESS'MOBILE guarantees the equipment sold for a period of one year from the date of delivery. In the event that the manufacturer of the equipment offers a warranty of more than one year, 2 months for reconditioned products, the after-sales service will no longer be provided by ACCESS'MOBILE but by the manufacturer directly. Items with a unit value of less than €25 are only guaranteed for 15 days from the invoice date.
8.2 Exclusion
The warranty does not cover defects and damage caused by external events, accidents, wear and tear or improper use. Also excluded from this warranty are products modified, repaired, integrated, added to or incorporated into installations not compatible with the equipment by the customer or any other person not authorized by ACCESS'MOBILE, as well as products covered by a specific support contract. Likewise, the warranty shall not apply to apparent defects or lack of conformity of the product, for which all claims must be made by the customer within eight (8) days of delivery of the products, failing which the warranty shall lapse. Interventions carried out under the warranty shall not have the effect of extending the warranty period.
8.3 Conditions
To benefit from the warranty, the customer must return the product in its original packaging, accompanied by all accessories (manuals, disks, cables, etc.) and the purchase invoice.
8.4 special provisions
ACCESS'MOBILE will carry out all warranty work in its workshop. However, ACCESS'MOBILE reserves the right to redirect the customer to the manufacturer of the defective equipment at its discretion.
Article 10 - retention of title
ACCESS'MOBILE remains the owner of the products ordered until full payment has been received. Any default in payment shall entitle ACCESS'MOBILE to repossess the unpaid products.
11.3 Warning
The customer chooses the products sold on the basis of the documentation and information that he acknowledges having received. It is the customer's responsibility to assess his own needs, to evaluate their suitability for the hardware and software purchased, and to ensure that he has the necessary skills for their use. Unless ACCESS'MOBILE has made a mistake in its assessment of the customer's needs and had all the necessary information at its disposal, products purchased by the customer will not be taken back, exchanged or reimbursed.
Article 12 - Protection of personal data
The personal information ACCESS'MOBILE requests from the customer is used solely to identify the customer and to process the customer's requests. It will never be communicated to third parties. The customer's personal data are processed in compliance with the French Data Protection Act of January 6, 1978, and their storage is subject to a declaration to the French Data Protection Authority (Commission Nationale de l'Informatique et des Libertés). The customer has the right to access, modify and withdraw this information.
Article 13 - Applicable law
The present conditions of sale and the operations mentioned herein are subject to French law. In the event of a dispute relating to the execution or interpretation of the present conditions of sale, only the Commercial Court of Cayenne shall have jurisdiction.
Article 14 - Acceptance
The present conditions are displayed in the store and on the website, and are available on request from ACCESS'MOBILE . Any order implies unreserved acceptance of these conditions.
